BLYM Terms of Service

1. Legal Notice and Service Description
These Terms of Service ("Terms") govern the use of the BLYM platform ("the Service") provided by SAS JUM, a French company registered under number 84419060300028, with its registered office located at 10 rue de l'ancienne mairie, 78600 Maisons-Laffitte, France. BLYM is a registered trademark of SAS JUM.

BLYM is a web-based software platform that enables companies to generate content for their websites using an intuitive editor, a scoring system, and an AI writing assistant.
The Service is intended primarily for business users (B2B), though it is accessible to anyone who subscribes to the platform. An account is required to use the Service, which may be created using an email/password combination or Google login. A trial version is available with one credit and does not require payment information.
2. Purpose of the Terms
These Terms define the legal framework governing access to and use of the BLYM platform. By creating an account or using the Service, you agree to be bound by these Terms.
3. Account Creation and Access
To access the Service, users must create an account. Users are responsible for maintaining the confidentiality of their credentials and for all activities that occur under their account.
4. Acceptable Use
Users must comply with all applicable laws and regulations when using the Service. Due to the limitations of AI providers (e.g., OpenAI, Anthropic, Mistral), certain topics may be restricted, blocked, or result in incomplete outputs. BLYM cannot guarantee content generation on such topics.
Examples of restricted content include:
- Explicit or pornographic material
- Hate speech or graphic violence
- Extremist or terrorist content
- Illegal drugs or substances
- Hacking or illegal activity
- Medical or legal advice
- Misinformation or conspiracy theories
- Harmful content involving minors
Restrictions may vary by provider and are subject to change without notice.
5. Generated Content and Intellectual Property
Users retain full ownership of the content they generate using BLYM.
By using the Service, users grant BLYM a non-exclusive right to use generated content for statistical analysis, product improvement, marketing, and internal research purposes.
All rights to the platform's codebase, interface, and database structure remain the exclusive property of SAS JUM.
6. Data Export and Termination
Users may export their generated content at any time. Accounts may be terminated at the user's request. Termination becomes effective at the end of the current billing period.
BLYM reserves the right to suspend or terminate any account without notice in the event of a material breach of these Terms.
7. Pricing, Payment, and Refunds
BLYM offers monthly and annual subscriptions, billed through Stripe, using credit cards or PayPal. Subscriptions renew automatically unless cancelled before the end of the current billing period.
Refunds are handled on a discretionary basis and may be requested by contacting support@blym.co. BLYM reserves the right to decline refund requests.
For users located in France, VAT is applicable. International customers are billed in either USD or EUR, depending on their location.
8. Warranty Disclaimer and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND.
BLYM DOES NOT GUARANTEE:
- CONTINUOUS AVAILABILITY OR ERROR-FREE OPERATION
- ANY SPECIFIC RESULTS OR SEO PERFORMANCE
- THE LEGAL VALIDITY OF GENERATED CONTENT
IN ALL CASES, BLYM’S LIABILITY SHALL BE LIMITED TO A MAXIMUM OF THREE MONTHS' SUBSCRIPTION FEES.
USERS ARE SOLELY RESPONSIBLE FOR ENSURING THAT GENERATED CONTENT DOES NOT VIOLATE THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS. USERS ACKNOWLEDGE THAT AI MODELS MAY HAVE BEEN TRAINED ON THIRD-PARTY CONTENT, AND THEY MUST VALIDATE THE LEGALITY OF THEIR OUTPUTS.
Users agree to indemnify and hold harmless SAS JUM and its affiliates from any claims, damages, or legal costs arising from their use of the Service or any content generated.
BLYM shall not be held liable in the event of force majeure, including but not limited to acts of God, cyberattacks, or service interruptions beyond our control.
9. Personal Data and Cookies
BLYM collects and processes user data in accordance with the General Data Protection Regulation (GDPR). Data may be hosted in Europe and the United States.
Cookies are used to enhance the user experience. By using the Service, you consent to the use of cookies.
BLYM may rely on subcontractors and third-party service providers (e.g., OpenAI, Stripe, hosting providers) to operate the platform and process data.
10. Modifications to the Terms
BLYM may update these Terms at any time without prior notice. Continued use of the Service constitutes acceptance of the updated Terms. Users who do not accept the changes may terminate their subscription at the end of the current billing cycle.
The sections related to Intellectual Property, Warranty Disclaimer, Limitation of Liability, and Governing Law shall survive any termination of this agreement.
11. Governing Law and Jurisdiction
These Terms are governed by French law. Any disputes shall fall under the exclusive jurisdiction of the Commercial Court of Versailles (Tribunal de commerce de Versailles).
In case of conflict between this English version and any French version of these Terms, the French version shall prevail. All disputes and proceedings shall be conducted in French.
